Terms and Conditions

PLEASE READ THIS AGREEMENT CAREFULLY

GENERAL

This agreement describes the general terms and conditions (the "General Terms and Conditions," the "Terms of Service," or the "Terms") applicable to the use of the services offered ("the Services") by Red Expertos SAS. Any "User/Customer" (natural or legal person) who wishes to use the services may do so subject to the General Terms and Conditions, together with all other policies and principles governing Red Expertos SAS and which are incorporated herein by reference.

Red Expertos SAS reserves the right to unilaterally modify the General Terms and Conditions at any time and without prior notice. The Terms shall be deemed to have been modified upon publication of the modifications made to the Terms on the Website www.Redexpertos.com. The User/Customer may express their disagreement with the new terms of service within 7 days of the date of publication in order to terminate the contract; otherwise, their acceptance shall be deemed to have been given.

The user shall be responsible for periodically reviewing the General Terms and Conditions, which may be modified without prior notice, provided that such modifications do not adversely affect the quality of the contracted services.

The Services are only available to individuals who have the legal capacity to enter into contracts. Individuals who do not have this capacity, minors, or Red Expertos Users/Customers who have been temporarily suspended or permanently disabled may not use the services. If the User is acting on behalf of a company, they must have the capacity to enter into contracts and bind the company to the terms of this Agreement.

By using our hosting services, you agree to abide by our policies based on respect, courtesy, and responsibility, due to the rights of other Internet users.

It is the responsibility of the User/Customer:

Keep backup copies of your files.

Keep the contact information and email address provided to Red Expertos up to date for notifications related to its services.

Important Note: The user is responsible for renewing domain names. Once the domain expires, it passes to the control of the ICANN representative and cannot be transferred, administered, modified, etc. It can only be activated through renewal. If the domain is not renewed, it will remain at the disposal of ICANN.

All services must be paid at least 3 days prior to their expiration date, otherwise the account will be suspended. Suspended accounts may be reactivated within 48 hours of suspension without incurring additional charges. Within the following 72 hours, the service may be renewed upon payment of the equivalent of 1 month's service as a reactivation fee.

The service shall not be used for any of the following conditions or purposes:

  • Sites that have an empty home page (at least one page under construction is required).
  • Directory or file names with accents or special characters.
  • Sites related to games and betting that are not authorized by law.
  • Content that promotes SPAM or UCE
  • Chat Rooms other than those included on the server
  • IRC Bots
  • Attempts to damage or access third-party accounts Users
  • Any other content or program that interferes with the operation of the server, causes security or stability issues
  • Sites specializing in sending bulk mail of any kind, or sending bulk emails that affect server performance.
  • Any Perl-based forum script for database access
  • Illegality in any form, including but not limited to activities such as unauthorized distribution or copying of unlicensed software or cracks, use of registered trademarks without permission, harassment, fraud, trafficking in obscene material, child pornography, racial or religious discrimination, MP3s, drug trafficking, and other illegal activities.

 

These policies are intended to serve as a guide and are not intended to be exhaustive. Acts that violate laws, regulations, or accepted norms in the Internet community, whether or not they are expressed in these policies, are prohibited.

Red Expertos reserves the right at all times to prohibit activities that damage its commercial reputation or goodwill.

The transmission, distribution, or storage of any material that violates any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret, or other intellectual property rights used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of unacceptable content or connections: pirated software, hacker programs or Warez files, IRC Bots, MP3 pornography, adult content.

Violations of system or network security are prohibited and may result in criminal and civil liability. Examples include, but are not limited to, the following: Unauthorized access, use, testing, or exploration of system security or data or traffic authentication measures. Interference with service to any user, server, or network, including, without limitation, mail bombing, flooding, DDOS, attempts to overload a system, and spreading attacks. Forging any TCP-IP packet header or any part of the header information in an email.

Red Expertos understands that abuse of the service may be intentional or unintentional. In all cases, abuse of the service will be determined by RedExpertos, and will not be tolerated under any circumstances. The User accepts that it is their responsibility to exercise due diligence in preventing abuse of the service.

The following are considered abuses of the service, including but not limited to:

The use of programs that consume more than 15% of server resource capacity for more than 30 continuous seconds.

Excessive errors generated by the User's pages, scripts, or other files or utilities used by the User. (7 per second, 12 per minute, 60 per day)

It is contrary to RedExpertos' policy for Users to use our servers to carry out or participate in any of the following activities:

  • Posting any off-topic message to any USENET or other newsgroup, forum, mailing list, or other similar group, according to the description of the list.
  • Sending unsolicited emails, if such unsolicited emails result in complaints from recipients SPAM.
  • Participating in any of the above activities using another provider's service, but routing such activities through a Red Expertos server, or using a server provided by RedExpertos as a mailbox for responses.
  • Falsifying user information provided to Red Expertos or other users of the service in connection with the use of a RedExpertos service.
  • Harm to minors is a violation of the law, and it is prohibited to use our services to cause any type of harm to minors, including but not limited to child pornography.

 

When Red Expertos becomes aware of a violation of its Terms of Use, Red Expertos will initiate an investigation. During the investigation, Red Expertos may restrict service to its User to prevent further unauthorized activity. Depending on the severity of the violation, Red Expertos may, at its discretion, restrict, suspend, or terminate the User's account and/or pursue other civil remedies. If such violation is a criminal offense, Red Expertos will notify the appropriate law enforcement authority of such violation.

Red Expertos reserves the right to unilaterally terminate this Agreement at any time if it considers that the service has been used inappropriately or that the User has violated the terms of service. No refund will be made for any amount proportional to the service not provided to Users whose service agreement has been terminated due to violation of the Terms of Service.

By accepting our services, you agree to hold Red Expertos and its distributors harmless from any legal action, penalties, losses, compensation, damages, costs, expenses, additional design costs, repairs, backups, programs, scripts, or airtime caused by or resulting from direct or indirect failures in the use of our services, to the User or other affected persons, without limitation or exception. This liability extends to all matters associated with your account, including the domain hosting account and RedExpertos representatives in the country where the company is represented.

Red Expertos provides the respective passwords and links for domain administration. These can be modified, and changes can be made to the DNS, owner, and other administrative activities. All domains will have a "lock" activated for security against hackers. This lock can be removed at the owner's request to transfer domains, with a minimum period of 30 days before the domain expires.

Payments and fees

At the end of each calendar year, Red Expertos will review the rates for the services it provides and may modify them on those dates for the following term. The User/Customer will determine the increase in rates, taking into account the change in the representative market rate of the dollar (TRM) plus the consumer price index. Such modifications will be notified to the User/Customer 15 days prior to their entry into force.

Red Expertos reserves the right to suspend or terminate this contract due to non-payment for the service.

Liability

Red Expertos shall in no case be liable for damages that are not a direct, immediate, and necessary consequence of its breach, nor shall it be liable for claims for punitive, indirect, incidental, or consequential damages, including lost profits, loss of income, or loss of savings, unless such damages result from gross negligence or willful misconduct, and Red Expertos' liability for damages, penalties, and any other obligations that may be enforceable against it shall not exceed, in aggregate, the amount equivalent to the monthly fee paid by the User/Client to Red Expertos under this instrument during the three-month period immediately preceding the date on which such event, act or omission.

Red Expertos shall not be liable for any loss, damage, or breach caused by unforeseen events beyond its control, including, but not limited to: war or threat of war, blockade, rebellion, invasion, insurrection, demonstration, civil commotion or violence, terrorist activity, sabotage, boycott, strikes affecting the User/Client or Red Expertos or third parties, floods, fires, earthquakes, damage to offices or military use of power, etc. If a force majeure event occurs, the affected party shall notify the other party in a timely manner. Red Expertos shall not be liable to the User/Customer for its inability or failure to perform, or delay in performing, any of its obligations under this contract caused by unforeseeable and irresistible events leading to a Force Majeure Event or fortuitous event. 

SHARED HOSTING

  • The minimum availability guarantee is 99.7% monthly.
  • All plans have restrictions on hosted files (inodes) with a maximum of 100,000.
  • All email accounts have a maximum storage capacity of 2 GB. This space is not additional to the space contracted in the plan.
  • This service is not designed to store backups.
  • Backups of shared hosting accounts are used for Red Expertos SAS's own purposes and are not included in the contracted product. Backups must be purchased as an additional service.
  • Copies made do not apply to email messages; only files corresponding to web pages and databases are backed up.
  • Backups will only be made for accounts that do not exceed a capacity of 10 GB in website files.
  • Upon cancellation of the service or failure to renew in a timely manner, the information stored on the server will be deleted without the possibility of recovery.
  • If your service is suspended due to a breach of the terms of service by the customer, you will not be able to access your information in any way.
  • When we receive your service order and process your payment, you will receive an email with the subject line "Service Activation," which confirms your acceptance of the terms of service.
  • Technical support requests are handled through the help desk soporte@redexpertos.com during business hours, Monday through Friday, from 8 a.m. to 5 p.m.
  • Extended hours support will be billed depending on the type of request.

 

VIRTUALIZED PLANS

  • The minimum availability guarantee is 99.7% monthly.
  • These plans have no file limitations; they are limited by the amount of space contracted.
  • Mailbox sizes are determined by the user without exceeding a maximum capacity of 25 GB.
  • This service is not designed to store backups.
  • Backups of shared hosting accounts are used for Red Expertos SAS's own purposes and are not included in the product. Backups must be purchased as an additional service unless included in the initial proposal.
  • Copies made do not apply to email messages; only files corresponding to web pages and databases are backed up.
  • Upon cancellation of the service or failure to renew in a timely manner, the information stored on the server will be deleted without the possibility of recovery.
  • If your service is suspended due to a breach of the terms of service by the customer, you will not be able to access your information in any way.
  • When we receive your service order and process your payment, you will receive an email with the subject line "Service Activation," which confirms your acceptance of the terms of service.
  • Technical support requests are handled through the help desk soporte@redexpertos.com during business hours, Monday through Friday, from 8 a.m. to 5 p.m.
  • Extended hours support will be billed depending on the type of request.

 

VPS or DATACENTER

  • The minimum availability guarantee is 99.7% monthly.
  • The content stored on the servers is the responsibility of the customer and must comply with the general terms of use.
  • There is no limit on stored files; the limit will be assigned based on the size of the machine contracted.
  • Any new developments must be reported through the channels designated for this purpose (email, telephone).
  • Backups for these plans are an additional service.
  • Upon cancellation of the service or failure to renew in a timely manner, the information stored on the server will be deleted without the possibility of recovery.
  • If your service is suspended due to a breach of the terms of service by the customer, you will not be able to access your information in any way.
  • When we receive your service order and process your payment, you will receive an email with the subject line "Service Activation," which confirms your acceptance of the terms of service.
  • Technical support requests are handled through the help desk soporte@redexpertos.com during business hours, Monday through Friday, from 8 a.m. to 5 p.m.
  • Extended hours support will be billed depending on the type of request.

 

CELERA BACKUP

  • The service is unmanaged; users are responsible for monitoring backup execution.
  • The amount of information selected will be calculated using the maximum monthly amount selected and not the amount of information selected at the end of the month.
  • Selecting information that exceeds the contracted capacity will result in an additional charge.
  • Any issues arising with the backups must be reported through the channels designated for this purpose (email, telephone).
  • Upon cancellation or termination of the service, the console where the information is backed up will be deleted without the possibility of recovery.
  • When service is suspended due to a customer's breach of the terms of service, the user will not be able to access their information in any way.
  • Technical support requests are handled through the help desk soporte@redexpertos.com during business hours, Monday through Friday, from 8 a.m. to 5 p.m.
  • Extended hours support will be billed depending on the type of request.
